Forensic Services:

  • Competency to Stand Trial Evaluations – Whether a defendant has the capacity to rationally and factually participate in legal proceedings.
  • Criminal Responsibility Evaluations – Whether a defendant at the time of an alleged offense was unable to control his behavior or understand the wrongfulness of his behavior by virtue of mental illness.
  • Aid in Sentencing Evaluations – Evaluations for the purpose of providing input to a judge or jury as to appropriate sentencing alternatives.
  • Competency to Plead or Waive Miranda Rights Evaluations – Whether a defendant had the mental capacity to rationally plead guilty to an offense or waive his right to presence of counsel.

Dr. Murphy has completed hundreds of evaluations of individual accused of or convicted of sexual offenses and has testified in related court hearings regarding possible sexual dangerousness.

Neuropsychological Evaluations:

  • Evaluations of possible effects of brain trauma or injury to capacity to fully function
Hundreds of thousands of individuals suffer head trauma each year and the damage resulting from these injuries is often subtle but profound, requiring extensive neuropsychological testing in addition to medical assessment.
  • Forensic Neuropsychological Evaluations – Assessment of the possible effects of brain injury or trauma on a defendant’s ability competently participate in legal proceedings and to have understood the wrongfulness of his alleged behavior in a charged criminal offense. Brain injury or long term developmental impairment may significantly effect an individual’s ability to fully rationally control behavior, and discovery of these deficits requires thorough neuropsychological assessment in the course of legal proceedings.
  • Fitness for Duty Evaluations – Whether a reported neurological or neuropsychological deficit is real or malingered, and the degree to which and individual’s deficits may impair their work related functioning.
